The present Regulations are made under the Westbank First Nation Self-Government Act. In particular, the Regulations set up the Westbank First Nation Land Registry which is a sub registry under the Self-Governing First Nations Land Registry held in Ottawa. It is a public registry that is password protected and can be accessed at no charge through the Helpdesk on the systems login page.
The present Act validates the Westbank First Nation Self-Government Agreement between Her Majesty the Queen in Right of Canada and Westbank First Nation of 3 October 2003. In particular, section 3 establishes that the Agreement is approved and has the force of law.
The purpose of this Agreement is to implement aspects of the inherent right of self-government by Westbank First Nation on Westbank Lands based on the recognition that the inherent right of self-government is an existing aboriginal right within section 35 of the Constitution Act, 1982.
The present Act approves, gives effect to and declares valid the Agreement between the Committee for Original Peoples’ Entitlement, representing the Inuvialuit of the Inuvialuit Settlement Region, and the Government of Canada.
This Act provides for the establishment of the Western Australian Land Authority and defines its composition, and functions and powers.Functions of the Authority include: the development of industrial, commercial, residential and other land in a range of localities to meet the social and economic needs of the State while taking account of environmental outcomes; the completion of the Joondalup
These Regulations implement the Western Australia Land Authority Act 1992 by prescribing duties of the board of the Authority. The board must each year prepare and submit to the Minister a strategic development plan and a statement of corporate intent as provided for in the Regulations.
