    For a long time sub-Saharan Africa has been considered to have abundant and underutilized land than any other continent. On the contrary, recent studies show that many rural Africans live in increasingly densely populated areas where all arable land is allocated or under cultivation. This has led to a long-term decline in farm size and reduced fallows.

    In Liberia it is estimated that around half the country’s land mass has been promised to foreign companies and investors. From 2009-11 the Sustainable Development Institute and NAMATI embarked on an action research project to support rural communities to protect, document, and manage their customary lands and natural resources. Drawing from lessons learned in the field, they sought to bring the voices and realities from rural Liberia to influential policymakers.

    Uganda’s northern region was traditionally inhabited by communities with predominantly pastoral lifestyles. As the country began developing administrative structures in the region, most clans found themselves settled into agro-pastoral communities. The elders found it imperative to demarcate areas of land to fit different uses, with areas for family settlement and cultivation clearly separated from other areas for communal use. Land was either demarcated by the leaders of a particular settlement or by the dominant clan for the benefit of everyone else in that area.

    Under Mozambique’s Constitution and Land Law (1997), communities may legally govern their lands and natural resources according to customary norms and practices, so long as local customs do not contradict national law. However, rising land scarcity and associated increases in land value are leading some families to “reinterpret” custom as sanctioning the dispossession of widows from their marital lands.

    Mozambique currently has one of the highest rates of land concessions throughout Africa. In the coming years, if large-scale land concession grants to private investors are not carefully controlled, the amount of land still held and managed by rural Mozambicans will decrease significantly, with associated negative impacts on already impoverished rural communities.

    Foi recentemente aprovada uma nova Lei de Petróleos, a Lei nº 21/2014, de 18 de Agosto. Nos termos desta lei, compete ao Governo regulamentar as matérias nela constantes, no prazo de 60 dias (artigo 70). Tendo sido elaborada uma Proposta de Regulamento da Lei de Petróleos, cumpre-nos analisar a conformidade da mesma com a lei, assim como tecer comentários sobre o novo regime, confrontando, sempre que necessário, com a legislação anterior.
