Two major innovations have inter alia emerged from the land reform in Madagascar: (i)

decentralised land management through the creation of local land offices, and (ii)

certification, which enables individuals to register private property provided the community

agrees on the legitimacy of the claimed rights.

Le Cadre d’analyse de la gouvernance foncière (CAGF) est un outil de diagnostic permettant d’évaluer le cadre juridique, les politiques et les pratiques en matière de gestion foncière et d’utilisation des terres.

Ce cadre conceptuel a été élaboré par la Banque mondiale depuis 2008 dans le cadre d’un partenariat avec la FAO, ONU- Habitat, le FIDA, l’IFPRI, l’Union africaine et des agences de développement bilatérales, comme outil de diagnostic permettant d’évaluer le statut de la gouvernance foncière d’un pays.

The Malagasy land reform, ongoing since 2005, belongs to the new generation of land reforms. It promotes the legal recognition of existing landholders’ rights (through certification) and the decentralization of land management. Despite the change of paradigm underlying this new wave of reforms, premises and expectations remain unchanged: a) rights legalization is justified by large tenure insecurity and b) rights formalization is a prerequisite to reduce conflicts over land rights, improve access to credit, boost productive investments and stimulate land markets.

Despite the general consensus on the need for land reforms to boost agricultural development, the lack of blueprint on required actions to safeguard land rights forces many countries to pilot various policy measures with mixed results. Using the TIA (Trabalho de Inquérito Agrícola) 2008 household and parcel level data from Mozambique, this study shows how demand for formalization of individual land rights depends on the source and type of tenure security risks.

mproving land governance is key in assuring that land resources can be enjoyed by all parts of the population. Donors can play an important role in combatting corruption in land administration and building a well-functioning land administration by both supporting domestic government efforts as well as engaging in international and multi-country initiatives. However, donors are advised by experts and civil society organisations to be mindful of the possible impact of their interventions on issues of land grabbing and forced relocations.

The land question in Kenya has never been solved. Land is a pertinent source of livelihood, the problem has persisted and in a number of years caused chaos as people grow impatient. Over time, there have been complaints from various communities and recently, the past governments have sought to listen the ailing communities. The National Land Policy and the National Land Commission characterize efforts to remedy the continued situation bedeviling the African communities.

I n order to safeguard long-term equitable and sustainable environmental management and governance, a clear and transparent relationship to land – whether an individual’s, a community’s, a government’s or a private investor’s – is essential. To this end, UNEP has begun to engage on land issues in Sudan, and will continue to do so through the next four year phase of programming, as part of supporting the people and the government of Darfur in rebuilding and redefining the social contract on natural resources and land.
