    This paper highlights the ways that the COVID-19 pandemic has affected and disenfranchised indigenous peoples and forest communities in Indonesia. The lack of adequate protection of the rights of indigenous peoples and their territories before the pandemic has been made worse by a lack of protection during the pandemic. The challenges faced by forest communities during the pandemic show that access to land and natural resources is crucial for the survival of communities whose livelihoods depend on the forest.

    This publication reveals that the majority of Southeast Asian countries already have plural legal systems, and to some extent custom is recognised as a source of rights in the legal framework of a number of them. National and international courts have affirmed indigenous peoples’ customary rights in land. And all these countries have endorsed and ratified key international human rights laws and treaties-- thus, the basis for securing indigenous peoples’ rights through a revalidation of customary law exists.

    The complaints procedure of the Roundtable on Sustainable Palm Oil (RSPO) is one of the options available to communities threatened by the negative impacts of the palm oil industry. Drawing on direct experiences of supporting communities to use it in Indonesia and Liberia, the report summarises how communities can get the most out of this procedure. Realistic outcomes include a temporary freeze on plantation development while longer term solutions are negotiated. Advises that several advocacy strategies be pursued simultaneously to maximise chances of success.
