    These Regulations make provision for the selection, designation, registration and notification of sites to be protected under the Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora. These Regulations also implement aspects of the Marine and Coastal Access Act 2009. They make provision in respect of European sites for: (a) control of damaging operations caused by human activity; (b) special nature conservation orders and restoration orders; (c) byelaws of the appropriate nature conservation body; and (d) compulsory acquisition.

    The Act sets out a series of measures which are designed to conserve biodiversity and to protect and enhance the biological and geological natural heritage of Scotland. In doing so, the Act provides the principal legislative components of a new, integrated, system for nature conservation within Scotland. The Act also locates the conservation of biodiversity and of Scotland's natural environment within a wider British, European and global context.

    The main purpose of this Order is to grant planning permission for certain classes of development without the requirement for a planning application to be made under Part 3 of the Town and Country Planning Act 1990. Schedule 2 to this Order sets out these classes of development in detail.

    This Order permits the management of development within a new two tier planning system with both district councils and the Department of the Environment operating as planning authorities where appropriate. An application for planning permission is to be made to the appropriate council or, as the case may be, the Department. The Order also deals with consultation before the grant of planning permission for development outlined in Schedule 3 and other procedures relative to planning permission application. Schedule 3 development also concerns water.

    This Order grants, subject to certain conditions, planning permission for certain classes of development under Part 3 of the Planning Act (Northern Ireland) 2011. Conditions are prescribed in part by regulations 55 and 56 of the Conservation (Natural Habitats, etc) Regulations (Northern Ireland) 1995 and for, among others, so-called EIA development, certain waterworks and development to be carried out on land which is within or affects: (i) a conservation area; (ii) a National Park; (iii) a nature reserve; (iv) an area of outstanding natural beauty.

    These Regulations make provision in Wales for the administration and enforcement of compliance of farmers with in relation to payments granted directly to farmers under the Regulation (EU) No. 1307/2013 of the European Parliament and of the Council establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy and rural development payments under Regulation (EU) No. 1305/2013 of the European Parliament and of the Council on support for rural development by the European Agricultural Fund for Rural Development.

    This Order is made under section 18 of the Agriculture Act 1986 which gives the Minister of Agriculture, Fisheries and Food the power to designate an area of England as an environmentally sensitive area. In such area particular agricultural methods shall be adopted so as to conserve, protect or enhance environmental features in that area. For this purpose the Minister may enter into a management agreement with any person having an interest in agricultural land in any designated area.

    The aid granted under these Regulations aims at the management of land of broadleaved woodland compatible with the requirements of the protection of the environment the beneficiaries of aid shall conclude an agreement with the Secretary of State in which management requirements laid down in the Schedule to these Regulations are included.
