    The Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security (VGGT) and the Framework and Guidelines on Land Policy in Africa (F&G) are important international and continental instruments for improving the governance of tenure of land, fisheries and forests for improved food security and nutrition. They are useful for dealing with the many tenure challenges confronting developing countries and set the standards and frameworks for improvement.

Mais pendant la colonisation, l’Allemagne et la France ont eu leurs propres codes fonciers. De même, en 1974, l’Etat togolais a entrepris une réforme agro pastorale. L’étude de cette évolution du droit foncier montre des différences entre le droit foncier coutumier akposso et le droit foncier moderne.

But it is also increasingly recognized through a variety of mechanisms, formal and informal. RECOFTC released a new report on the recognition of customary tenure of communities living in forested landscapes in Cambodia, Lao People’s Democratic Republic, Myanmar and Viet Nam. It also includes a case study from Thailand.

    Land, Law and Chiefs in Rural South Africa analyses contestations of power and control over land through the lens of local case studies in the densely settled former African ‘homelands’ or Bantustans. These were areas reserved for African occupation by the apartheid government and when the ANC came to power in 1994, they were the poorest and least developed parts of the country. Over the last few decades, mineral deposits have been exploited and some are located close to the boundaries of rapidly expanding cities, such as Durban, where peri-urban land is at a premium.

    This article discusses the inherent limitations of law in transitional justice processes regarding land grievances. Through analysis of the case of Timor-Leste (East Timor), a country marked by post-colonialism, post-authoritarianism, and post-conflict. The article shows how complex transitional justice regarding land grievances can be, and argues that a legalist perspective gives a limited view of these grievances, both for studying and finding solutions to them. The article employs the concept of ‘wicked problems’ to overcome the limitations of law.
