Land corruption – corrupt practices in the land sector – threatens the lives and livelihoods of people and communities, the environment and climate, food security and political stability. Its impacts are particularly acute for 2.5 billion people who live on and from the land. Limiting global warming to the 2°C target that countries have committed to in the 2015 Paris Agreement, and reaching the Sustainable Development Goals by 2030, will require large-scale expansion of climate-resilient approaches in agriculture and food systems. In order to achieve the scale of change required, coordinated action is needed from global to local levels, from research to policy and investment, and across private, public, and civil society sectors.

This article discusses the implication of the 2021 CASAC v Ingonyama Trust judgment on South Africa’s land governance policy trajectories. It explores the extent to which there are missing links between policy imperatives, the legal system, court processes and socio-economic emancipation. It argues that the failure of the state in policy design and implementation has turned courts into contradictory sites of struggle for emancipating land rights.

Questions about how land is governed and controlled in the context of multiple crises are key to debates about fair transitions. The energy transition, net-zero ambitions, nature protection, and food system transformation all involve claims on land, water, and forests. How these claims are framed, analysed, and governed, how access to land is organised, and who gets a seat at the table to discuss key decisions are questions of urgent concern from both a fair transitions perspective and a land governance perspective. Reports & Research
    October, 2023
    Mozambique

The race for the exploitation of natural resources has brought challenges of different natures, including land conflicts, mainly between investors and the local population. In some cases, the resolution of problems has been unfair due to the lack of legal knowledge and representation to help the vulnerable population. It is in this context that the paralegal figure was established, endowed with solid knowledge to voluntarily provide basic legal support to community members.

Land access is becoming a crucial issue in many African contexts, where groups and individuals are coping with land scarcity and increasing competition over resources. Based on fieldwork carried out in the southwestern region of Togo, this paper explores the plurality and adaptability of the forms of land access that have historically emerged from changing economic and political landscapes characterized by the rise and the decline of cocoa cultivation.
