    This article discusses the implication of the 2021 CASAC v Ingonyama Trust judgment on South Africa’s land governance policy trajectories. It explores the extent to which there are missing links between policy imperatives, the legal system, court processes and socio-economic emancipation. It argues that the failure of the state in policy design and implementation has turned courts into contradictory sites of struggle for emancipating land rights.

    Nature-based solutions (NbS) include all the landscape’s ecological components that have a function in the natural or urban ecosystem. Memorial Parking Trees (MPTs) are a new variant of a nature-based solution composed of a bioswale and a street tree allocated in the road, occupying a space that is sub-utilised by parked cars. This infill green practice can maximise the use of street trees in secondary streets and have multiple benefits in our communities. Using GIS mapping and methodology can support implementation in vulnerable neighbourhoods.

    Land Portal and the Council for Scientific and Industrial Research (CSIR) have collaborated on this project designed “…to uncover, democratize and improve the land data and information ecosystem in South Africa” (Land Portal Foundation, 2019). This is one of a number of State of Land Information (SoLI) projects in an international process covering a number of countries. The first part of the project involved in-country teams scoping the information landscape (resulting in this report).

    The Voluntary Guidelines on the Responsible Governance of Tenure (VGGT) call for governments to clearly define the term ‘public purpose’ to allow for judicial review of the goals of expropriations of property. However, recent research indicates that national-level legal frameworks that govern expropriation decision-making not only vary greatly from country to country but also often fail to comply with the VGGT standards on expropriation. This creates the potential for unpredictable and, in some cases, arbitrary applications of expropriation law in practice.

    This report, a summary of the substantial challenges that continue to plague South Africa’s efforts to reform land administration system, proposes that key decision-makers and informers involved in communal land administration undergo a mindshift in thinking. This shift should be from focusing exclusively on transferring communal land to traditional leaders, Common Property Institutions and private individuals, to recognising and accommodating existing forms of social tenure.

    This paper examines the current wave of land tenure reform in eastern and southern Africa. It discusses how far tenure reform reflects a shift in powers over property from centre to periphery.     This paper documents a participatory approach for supporting black South Africans in developing knowledge and skills to use land, acquired under the land reform scheme, more effectively. This approach enables land reform groups to work jointly through a sequence of steps in order to develop and implement a land management plan.The participatory planning method can be summarised into four main stages. First, the land reform group seeks to understand how the agricultural sector operates in its area, and identifies those agencies that provide technical and managerial support.
