    In South Africa, policies of separate development and restrictions placed on capital expenditure imposed on the lands occupied by the indigenous people during the colonial era prevented the state from implementing the cadastre in the communal areas of the country. The status quo persists to this day, which has resulted in a dual system that promoted investment in areas where private property rights were permitted, but relegated the traditional communities into poverty and disinvestment

    Globally, the conservation and tourism sector is being enthusiastically promoted as one of the key mechanisms to catalyze rural local economic development. This is particularly relevant in South Africa where tourism is considered an important sector for Black Economic Empowerment and community development. However, there is increasing concern that the impact of tourism and conservation on local communities is not always beneficial and can include a range of negative livelihoods consequences.

    Approaches to securing tenure have been dominated by debates about whether titling advances secure land tenure and development in developing countries or whether it is either ineffectual or detrimental to socially more relevant systems. While the policies of many developing countries, including South Africa, continue to support titling approaches to securing tenure, there is widespread confirmation in the literature that title can be problematic for poor people living in both urban and rural areas.
