    This Law, consisting of 183 articles divided into 13 Chapter, prescribes rural and urban house ownership, development, management and use; house transactions; and state management of housing in Vietnam. Transactions of purchase, sale, lease or lease-purchase of commercial houses of real estate businesses and cooperatives must comply with the law on real estate business. This Law applies to organizations, households and individuals involved in urban and rural house ownership, development, management, use and transactions, and state management of housing in Vietnam.

    This Act aims at financing the acquisition by the Government of land estates for division and resale to small landholders, as well as the purchase of the landholding by the agricultural lessee from the landowner, there is hereby established a body corporate to be known as the "Land Bank of the Philippines", which shall have its principal place of business in Manila. The legal existence of the Bank is extended for a period of fifty years from the expiration of its original term on 08 August 2013, renewable for another fifty years.

    This Act lays down basic provisions on land tenure, both rural and urban. All land in Viet Nam is the property of the State, but individual and corporate users, both domestic and foreign, can obtain from the State usufructuary rights under lease-type contractual arrangements (art. 1). Long-term leases, in particular, of cropland are made for twenty years for annual crops and aquaculture, and for fifty years for perennial crops, both terms being renewable on expiry (art. 20).

    The present Act makes provisions in matter of tenure of lands intended for padi cultivation, with a view to controlling related rent and security of tenure. Sections 3 to 10 lay down rules concerning tenancy agreements by which a landlord agrees to let and a tenant agrees to take any padi land for the purpose of cultivating padi. Tenancy agreements must be concluded in writing and in compliance with the form prescribed by Form A of the First Schedule. After its conclusion, the agreement shall be registered.

    Various definitions set out in sections 4 and 5 are modified notably the definition of "leasehold tenancy". Section 9, providing for contractual implications in the case of severance of relationship between landlord and tenant, is completely rewritten. The tenant shall have the right to change the tenancy contract from a share tenancy to leasehold tenancy and vice versa and from one crop sharing arrangement to another (sect. 14). The landholder shall have the right to choose the kind of crop and the seeds that the tenant shall plant in his holdings (sect. 25).
