    This Law, consisting of 183 articles divided into 13 Chapter, prescribes rural and urban house ownership, development, management and use; house transactions; and state management of housing in Vietnam. Transactions of purchase, sale, lease or lease-purchase of commercial houses of real estate businesses and cooperatives must comply with the law on real estate business. This Law applies to organizations, households and individuals involved in urban and rural house ownership, development, management, use and transactions, and state management of housing in Vietnam.

    This Law prescribes for the land ownership, powers and responsibilities of the State in representing the entire-people ownership of land and uniformly managing land, the land management and use regimes, and the rights and obligations of land users over the land in the territory of Vietnam. The persons taking responsibility before the State for land use are: 1. The head of an organization, a foreign organization with diplomatic functions, or a foreign invested enterprise, is responsible for the land use by his/her organization. 2.

    Law amending and supplementing a number of articles of the Land Law. Amendments of the principal Law concern ownership of land by the people of Vietnam and management of land by the State (art. 1), protection of land use rights by the State (art. 3), assignment of land by the State to organizations, households and individuals (art. 4), and exemption from payment of land use levy (art. 22). Three new articles are added to the Law after article 22: they further specify when payment of land use levy is due. Four new articles are added to the Law after article 78.

    This Act lays down basic provisions on land tenure, both rural and urban. All land in Viet Nam is the property of the State, but individual and corporate users, both domestic and foreign, can obtain from the State usufructuary rights under lease-type contractual arrangements (art. 1). Long-term leases, in particular, of cropland are made for twenty years for annual crops and aquaculture, and for fifty years for perennial crops, both terms being renewable on expiry (art. 20).
