    This Act provides with respect to leases and sales of settled estates. “Settled estates” signifies land, and any estate or interest therein, which is the subject of a settlement. “Settlement” signifies any instrument under or by virtue of which any land or any estate or interest in land stands limited to or in trust for any persons by way of succession. The Act sets out requirements and procedures for to leases and sales of (rights on) settled estates under authority of the court or by a tenant for life.

    This Act provides rules relative to sale and other transactions concerning land. It also concerns (statutory) mortgages, easements and selected matters regarding leases. The Act requires contracts for sale etc. to be in writing. All conveyances of land or of any interest therein are void for the purpose of conveying or creating a legal estate unless made by deed. The Act specifies covenants that may be included in a deed. Mortgaged land may be leased by mortgagee or mortgagor for agricultural or mining purposes. As for mortgages the Act specifies procedures for execution.

    The Act provides with respect to the amount of compensation payable for damage to agricultural crops and fruit trees. Where the damage amounts to total destruction, the compensation shall be calculated at the rates set out in the Schedule. If the damage is partial, the compensation shall be calculated on that proportion of the amount for total destruction directly attributable to the damage as may be determined by assessors appointed by the parties within four days of the occurrence of the damage.

    This Act makes provision with respect to development of land in Montserrat and for these purposes establishes the Montserrat Land Development Authority. The Authority shall be a body corporate and shall encourage and secure the efficient and economic utilization of land vested in it or acquired by it in the interest of the people of Montserrat. The Authority shall develop land for agricultural settlement schemes in any area designated by the Governor in Council under section 18 of this Act.

    This Act provides for control of tenancy contracts of small holdings, i.e. parcels of land intended for cultivation or pasturage, with or without buildings thereon, consisting of not less than a quarter of an acre and not more than 25 acres. The Act provides rules relative to contracts of tenancy and provides with respect to evidence of registered contracts. A contract of tenancy shall be registered by the landlord with the Registrar of the High Court.

    This Act establishes the Agricultural Rent Board for purposes of control of rent of small holdings, i.e. parcels of land intended for cultivation or pasturage, with or without buildings thereon, consisting of not less than a quarter of an acre and not more than 25 acres. The Board shall have the power and duty to determine the standard rent of small holdings situated in any controlled area in Montserrat.

    This Act regulates the purchase of freeholds in tenantries. A tenantry means a tenantry specified in the First Schedule (a plantation tenantry) and an area of land, including public land, subdivided before a specified date into lots for letting for specified purposes. “Tenantry” does not include land adjoining the foreshore. The purpose of this Act is to establish by law a right for tenants of lots in tenantries who satisfy the requirements of this Act to purchase the freehold at a purchase price governed by considerations of public policy and the requirements of the Constitution.

    An Act to make provision respecting the purchase by tenants of agricultural holdings for the purpose of facilitating agricultural development in Barbados.

    This Act prescribes that it shall be a term or condition of every tenancy of an agricultural holding of a plantation specified in the First Schedule to this Act that a qualified tenant may purchase the freehold of that agricultural holding at a price to be agreed upon between the landlord and tenant. “Agricultural holding” is defined by the Security of Tenure of Small Holdings Act. A qualified tenant is a tenant that has been cultivating the holding for a specified number of years. An option to purchase shall be exercised in the form as set out in the Second Schedule to this Act.
