    This Law prescribes for the land ownership, powers and responsibilities of the State in representing the entire-people ownership of land and uniformly managing land, the land management and use regimes, and the rights and obligations of land users over the land in the territory of Vietnam.     This Act makes provision for a wide variety of matters relating to land tenure and reform in Lesotho including the definition of rights in land, allocation of land in rural areas, grant of title in land, vesting of land in authorities, government acquisitions and acquisition and expropriation of land for public purpose, grant of long-term leases and regularization and adjudication of title in land, including resolution of disputes by specialized land courts established under this Act. All land in Lesotho is vested in the Basotho Nation and is held in trust by the King.

    The Act consists of 95 sections divided into 8 Parts. In Chpater I of Part I the various types of agricultural tenancy are defined. Chapter 2 contains general provision as to new types of tenancy. Part 2 provides for the tenant's right to buy land. Part III concerns diversification of use of land under agricultural tenancy. A tenant under a tenancy mentioned in section 39(1) who intends to use the land for a non-agricultural purpose must send a notice to the landlord. The landlord may object to the notice of diversification under certain circumstances (sect. 40).

A secure tenancy is a long term heritable tenancy with security of tenure and a succession right An agricultural holding is the consolidation of agricultural land, fixed equipment, house, buildings, in any tenancy arrangement between a landlord and a tenant farmer.

    The Act provides with respect to the amount of compensation payable for damage to agricultural crops and fruit trees. Where the damage amounts to total destruction, the compensation shall be calculated at the rates set out in the Schedule. If the damage is partial, the compensation shall be calculated on that proportion of the amount for total destruction directly attributable to the damage as may be determined by assessors appointed by the parties within four days of the occurrence of the damage.

    This Act makes provision with respect to small holdings i.e. any land or parcel of land with or without a dwelling house or other building erected or to be erected thereon not exceeding in all five acres in area let for agricultural purposes and of a specified maximum total value. The Act specifies the (contractual) rights of a tenant of a small holding including the use and enjoyment of all ground crops, plants, fruit trees or other trees. The Act also specifies rights of the landlord and provides with the resolution of disputes between the parties to any contract under this Act.

    This Act provides rules relative to tenancy agreements concerning agricultural holdings, i.e. the aggregate of the land comprised in a contract for an agricultural tenancy. The Act among other things: places a restriction on letting agricultural land for less than from year to year, defines various other terms of contract, also in relation to cultivation of land and disposal of produce, and provides with respect to arbitration in relation with tenancy agreements.

    This Act regulates the purchase of freeholds in tenantries. A tenantry means a tenantry specified in the First Schedule (a plantation tenantry) and an area of land, including public land, subdivided before a specified date into lots for letting for specified purposes. “Tenantry” does not include land adjoining the foreshore. The purpose of this Act is to establish by law a right for tenants of lots in tenantries who satisfy the requirements of this Act to purchase the freehold at a purchase price governed by considerations of public policy and the requirements of the Constitution.
