    This Act amends the Shooting and Fishing Leases Act by replacing section 18. That section grants power to the Minister to make regulations for the purposes of this Act, and, in particular, but without prejudice to the generality of that power, may make regulations – (a) for the levying of charges and the taking of fees; (b) amending the Schedule. Regulations made under this section may provide that any person who contravenes them shall commit an offence and shall, on conviction, be liable to a fine not exceeding 20,000 rupees and to imprisonment for a term not exceeding one year.

    This Ordinance of the Legislature of Mauritius concerns the award of lease of the right to shoot and go in pursuit of game and to fish, hunt or fowl on Crown Lands. The Ordinance sets out procedural requirements for such award by the Minister, which may be done through public auction. There shall be attached to the deed of lease a plan showing the boundaries of the land to which the lease refers. A lease may be for any period not exceeding fourteen years. the Ordinance also sets out rights and obligations of lessees.

    This Act regulates the alienation, lease and use of and control over “State land”, i.e. defence lands, ‘pas géométriques’ and all lands belonging to or in possession of the State. The Minister may sell State land other than defence lands, mountain reserves which belong to the State, ‘pas géométriques’ or river reserves which belong to the State (sect. 3). No State land shall be granted or leased otherwise than at its full rental value except for charitable purposes (sect. 4).

    The provisions of this Act deal with various matters relating to crown lands, such as sale, leases, control over land settlement, jouissances, curatelle lands and exchange of crown lands.Section 4 provides that no land shall be granted or leased otherwise than at its full rental value with an exception of the grant or lease for charitable purposes. All sales of land shall be by public auction (sect. 5). Section 7 contains rules for sale or lease by auction. Control and supervision over land settlement shall be vested in the Chief Agricultural Officer (sect. 15B).

    The Act provides for the compulsory acquisition of land and the compensation of losses resulting from such acquisition. Section 5 provides for the acquisition of private land by persons requiring such and not having been able to acquire the land by private agreement. In accordance with section 6, the Minister may issue an investigation notice in respect of land likely to be compulsorily acquired. Section 8 provides for notices of compulsory acquisition to be published in the Gazette and two daily newspapers.
