La ingobernabilidad de la ZMT es producto de la inadecuada aplicación del marco legal y la ausencia de conocimiento sistematizado. La información sobre esta temática está muy dispersa, es escasa y además, poco accesible.

    Since the collapse of the Soviet Union and agricultural decollectivisation, post-socialist rural contexts have afforded commons scholars particularly fertile ground for examination of institutional change and evolution under new modes of governance. In Mongolia, as elsewhere, such transformations have been characterised by the erosion of state influence and de jure and/or de facto devolution of land and resource rights.

    This paper draws on research on the enforcement of the Land Act of 1979 in Lesotho. It seeks to show that illegal settlements occur under the shadow of formal state rules, from which social actors borrow selectively and in opportunistic ways to acquire urban property rights. This is possible because of inconsistencies and contradictions in state rules and enforcement methods.

    • provides a framework for the development of generally acceptable guidelines for companies seeking FPIC.

    The LANDac Conference 2018 looked at land governance through the lens of mobility. Land acquisitions trigger migration and yield other types of mobility such as capital, goods and ideas. Ensuing land claims raise new questions for land governance. So far, the discussion has focused on respecting land rights, informing local residents and offering fair compensation. The conference explored the question: Given the variety of mobility, what are good ways forward in land governance?

    This paper analyses the Zambian land governance system, the actors and institutions shaping it and its reaction to the new interest in farmland. We draw theories from New Institutional Economics and base our empirical analyses on expert interviews and focus group discussions conducted in Zambia.
