While emissions trading already began in the late 1980s and early 1990s, carbon markets can officially be traced back to the Kyoto Protocol of 1997. The Kyoto Protocol introduced market-based mechanisms allowing countries to trade emission allowances and invest in emission reduction projects overseas. On this basis, the European Union Emissions Trading Scheme (EU ETS) was launched in 2005, pioneering the introduction of large-scale, regulated carbon trading systems.

They argue that formalizing local forest rights will have positive outcomes for livelihoods as well as forest conservation. In response to these calls, many governments have started forest reforms. Indigenous peoples and other local communities (IPLCs) are essential for forests, climate, biodiversity, public health and a host of other local and global ecosystem services. Securing IPLC land rights, helping protect their lands from external threats and supporting their forest management efforts would allow IPLCs to contribute even more to these public goods. Evidence on IPLC forest management has been accumulating steadily over the last decade since this matter gained attention in the climate change policy circles.

This report seeks to investigate and propose mechanisms that can be used to improve the flow of benefits to mining-affected communities. The report sets out what requirements should be met for a community trust (or similar legal vehicle) to offer protection of trust assets. It sets out recommendations on the manner in which the legal document should be crafted to protect communities, and proposes that the time is ripe for regulation and clarity. Although it is focused on South Africa, it will be relevant for countries facing similar challenges in the mining and other commercial sectors.

Forest Peoples Programme and partners have encountered and documented human rights violations against indigenous peoples and local communities associated with conservation over the course of decades of work. There have been moments when progress in this area has been made (e.g., the 2003 Durban Accord and the adoption of social policies by conservation agencies). However, changes to practice on the ground have too often been limited or quickly reversed, despite repeated calls by human rights organisations over decades. These issues are widely known, they cannot be ignored.

The conceptual framework for Land Degradation Neutrality (LDN) highlights that land degradation in developing countries impacts men and women differently, mainly due to unequal access to land, water, credit, extension services and technology. It further asserts that gender inequality plays a significant role in land-degradation-related poverty hence the need to address persistent gender inequalities that fuel women’s poverty in LDN interventions. This paper presents recommendations for moving towards a twin-agenda: gender equality and land degradation neutrality.
