   This Order validates the Instruction for calculation of environmental damages caused to soil as a result of violation of environmental legislation and also in case of emergency situations of technological type and natural disasters. This Instruction shall be applicable to: (a) soil pollution by chemicals; (b) unauthorized waste disposal; and (c) unauthorized (unlawful) artificial covering of soil. It shall not be applicable to radioactive and biological soil pollution. The Instruction establishes calculation formula for soil pollution and methodology for calculation of damages.

   This Regional Law establishes that lease payment and concession payment shall be determined on the basis of forestry taxes. Rates of payment shall be fixed in lease contract, concession, forestry licence or forest management permit. All forestry taxes and payments cannot be lower than minimum forestry taxes and payments fixed by law. Payments for building timber and fuelwood shall be equal to minimum forestry taxes applicable to standing timber. Land tax for forest parcels shall be fixed as minimum forestry tax applicable to standing timber.

   This Ministerial Decree establishes the modalities for calculating and collecting compensation for the transfer of forested areas to a category of land not related to forest management. The amount of payment shall be established in accordance with the basic rate set for a given category of forest, based on the composition and productivity of forest. In the process of calculation, the period of time of the transfer shall also be taken into consideration. Payments for the transfer of forested areas to establish protected areas shall be prohibited.
