The Transformation of Land Law in Indonesia: The Persistence of Pluralism
    Peer-reviewed publication
    January, 2010
    Indonesia

Transforming a pluralistic tenure system into unified statutory rights has been a major objective of the development of property law in many developing countries. Many law and development scholars have assumed that unified land rights are a pre-condition to development and that a pluralistic tenure land system is a major source of uncertainty and insecurity. This article challenges this commonly held assumption by way of a case study of Indonesia's effort to unify the laws governing land.

AFTER 200 YEARS, WHY IS INDONESIA’S CADASTRAL SYSTEM STILL INCOMPLETE?
    Policy Papers & Briefs
    February, 2016
    Indonesia

This paper discusses Indonesia’s experience with establishing a uniform cadastral system in rural areas since the idea was first mooted in the early 19th century. Until 1961, a formal cadastre that identified, measured, registered and certified land titles existed only in urban areas. A cadastre for rural land did not start until after the 1960 Agrarian Law. Until then, the village-based land tax registers acted as a substitute cadastral register in areas subject to land tax.

This study draws on some case studies of land reforms in different South Asian countries. These reforms came on the national and international agenda in a major way in the post- World-War II period and were led by the transition theory, requiring agriculture to provide both surplus and labor for the growth of a modern industrial economy and leading to focus on efficiency in agricultural production (which would release resources -capital and labor- for investment in the modern industrial sector), rather than on distribution.

The paper describes underlying causes of conflicts between local people in Bulungan Research Forest (BRF), Indonesia with coal-mining and logging companies. Results show that conflict between local people and mining companies was triggered by the fact that mining operation caused water and air pollution and soil degradation. Another cause for such a conflict was the compensatory facilities (e.g. clean water, electricity, compensation fee, etc.) provided by the companies to local people were often delayed or unsatisfactory.

For co-management of conservation areas to be effective, detailed information on local people's use of natural resources is essential. One method to obtain some of that information, a household record keeping study, is given. It is simple to implement and analyse, and provides useful, quantitative data on resource use and income levels. The method and present data derived from three studies of Melayu and Iban communities in and around the Danau Sentarum Wildlife Reserve in West Kalimantan, Indonesia, are described.
