This Law consisting of 65 articles divided in IV Parts and 10 Annexes aims at protecting the environment (land, air and water) from pollution. To achieve the objective the Environmental Affairs Agency (EEAA) is established for the protection and promotion of the environment.
This Law is composed of 7 Chapters, 33 articles and 2 Indexes. Preliminary provisions (chap. I)which shall include the following matters: name of the Law; abrogation of Law No. 40 of 1974; and terms and definitions. Establishment of the Project, management of the Administrative Board and functions and duties of the Board are provided for in Chapter II. Nomination of the Commissioner and definition of its duties is dealt in Chapter III. Project's founds; devolution of properties; and land tenure are contained in Chapter IV. Financial provisions are provided for in Chapter V.
Cette loi modifie les articles 16 et 27 de la loi nº 95-21 portant régime relatif aux immeubles domaniaux agricoles. On entend par immeubles domaniaux agricoles les terres dont l'Etat est propriétaire et qui sont destinées à la production agricole, celles pouvant servir de support à cette production ou celles qui ont été classées comme telles, ainsi que les bâtiments qui s'y trouvent.
This Law is composed of 6 articles: public desert areas can be rented at nominal rates for investment projects (art. 1); the transfer of property will be completed after the realization of the project and effective production (art. 2); the rent period must not exceed (40) years, renewable as long as the project continues (art. 3); such land is to be used only for the designated objective (art. 6).
Cette loi a pour objet de fixer la consistance technique et le régime juridique du patrimoine foncier ainsi que les instruments d'intervention de l'Etat, des collectivités et des organismes publics.
Cette loi fixe le mode d'exploitation des terres agricoles. L'Etat est propriétaire, mais la loi consent aux collectifs agricoles un droit de jouissance cessible et perpétuel des terres. La loi décrit la nature et la composition des collectifs. Les agriculteurs acquièrent tous les droits sur ces terres, à l'exception du droit de propriété. Les collectifs doivent verser une redevance à l'Etat. Celui-ci cesse de rémunérer les travailleurs agricoles. Cette loi abroge l'ordonnance nº 68-653 du 30 décembre 1968 et les articles 858 à 866 de l'ordonnance nº 75-58 du 26 septembre 1975.
