La présente étude est un e tentative de présentation des tendances d’évolution en Afrique de l’Ouest du droit pastoral en général, et des législations pastorales en part i culier. Elle porte sur un échantillon de pays suivants choisi s uniquement sur la base d’un e grande similitude des règles juridiques et institutionnelles, ainsi qu e des pratiques traditionnelles et coutumières en vigueur: Burkina Faso, Guinée, Mali, Mauritanie, Niger et Sénégal. L’objectif poursuivi est essentiellement la co nnaissance de s grandes tendances actuelles des législations pastorales .

In recent years, local people and rural communities have assumed increasing prominence in strategies for natural resource management.This paper briefly reviews some of the central legal issues that are associated with this shift. In doing so, its goals are limited. It does not ad dress fundamental questions about when, where and what kind of management works, nor attempt to identify the political, social, economic and environmental ingredient s for success – subjects on which there is a huge, if still inconclusive, literature.

Quels enseignements peut-on tirer des expériences de mise en œuvre des Plans fonciers ruraux dans la perspective de la formulation de politiques et de législations foncières adaptées en Afrique de l’Ouest et d’amélioration des stratégies de sécurisation foncière des droits des producteurs ruraux ? La présente étude vise à répondre à une telle question à travers une analyse de la mise en œuvre des opérations de Plan foncier rural au Bénin, au Burkina et en Côte d’Ivoire. Il s’agira de rendre compte de la diversité des pratiques mises en oeuvre en fonction ocaux.

The study aims to clarify the various issues regarding land security of poor and other marginalized groups in Malian rural areas. It looks into questions relating to how poor and vulnerable groups obtain access to land and natural resources, and what factors cause their exclusion. It analyzes existing methods for formalizing land rights and land transactions and their impacts on the poor. Specific attention is given to the practical organization of the procedures for formalization and recording land rights.

Land lies at the heart of social, political and economic life in much of rural Africa. It provides a major source of livelihoods, income and employment; a basis for social and political relations; and has major historical, cultural and spiritual significance. In many places, rapid socio-economic changes are undermining the security of land access for poorer and more vulnerable groups – particularly in high-value lands such as peri-urban areas, irrigated schemes and fertile lands.

Given the recent trend of granting vast areas of African land to foreign investors, the urgency of placing real ownership in the hands of the people living and making their livelihood upon lands held according to custom cannot be overstated. This study provides guidance on how best to recognize and protect the land rights of the rural poor. Protecting and enforcing the land rights of rural Africans may be best done by passing laws that elevate existing customary land rights up into nations' formal legal frameworks thereby making customary land rights equal to documented land claims.

The effect of prime-age adult death and its consequences on access to land for the survivors has not been fully explored nor incorporated into policy regardless the fact that high adult mortality is now the lived reality in countries affected by HIV/AIDS, particularly in Africa. This paper explores the gendered relationships between adult death due to HIV/AIDS and changes in land rights for the survivors particularly widows. In many African societies, women have traditionally accessed land through marriage.
