El objetivo de este artículo es llamar la atención sobre la ocupación de la zona marítimo-terrestre (ZMT). En estos territorios coexisten situaciones legítimas, anómalas y anárquicas respecto con la tenencia de la tierra. La ingobernabilidad de la ZMT es producto de la inadecuada aplicación del marco legal y la ausencia de conocimiento sistematizado. La información sobre esta temática está muy dispersa, es escasa y además, poco accesible.

En el presente artículo de investigación las personas autoras realizan un estudio histórico- jurídico de las principales políticas públicas agrarias promulgadas por el Estado costarricense desde el año 1821 hasta la actualidad. El análisis se realiza a través del estudio de las principales normas jurídicas de distinto rango emitidas por el Estado, buscando determinar fines y objetivos e intereses de los diferentes sectores de la sociedad de cada época. Adicionalmente se evalúan los efectos e impacto de esas políticas en la realidad agraria y rural del país.

A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.

However, most people in rural areas in developing countries do not have any form of documentation to protect their land and natural resources rights, which puts their livelihoods and consequently their food and nutrition security are at risk. Secure tenure rights promote responsible investment in agriculture that could increase productivity and enhance food security and nutrition.
