    Sections 10, 11, 12 and 13 of the principal Act are repealed by this Act. The repeal of sections 10, 11, 12 and 13 of the principal Act shall not affect: (a) any declaration, order, or rule made, certificate authority or permit granted, registration effected or other thing done; or (b) any right, privilege, obligation or liability acquired, accrued or incurred. Section 9 is amended accordingly.

    This Order shall apply only to Crown land, European land, and European interests in Native land. It shall be the duty of the Registrar appointed under this Order to prepare, in such manner as may be approved by the Chief Judge of the High Court, a register, to be called the Land Register, of the legal title to all Crown land, European land, and European interests in Native land existing in Samoa at the commencement of this Order "European interest in Native land" means any estate or interest held in Native land otherwise than by virtue of Native custom.

    This Chapter concerns use and lease of public land. The Public Lands Trust Board of Trustees may, subject to provisions of this Chapter, authorize use and lease agreements in respect of public lands. Land may be leased to foreign companies but only for the time they are doing business in Pohnpei. Rights to minerals and exhaustible resources and other uses defined by the Board to be of public interest. The Chapter also places restrictions on subleases of residential leases issued by the Pohnpei Public Lands Trust Board of Trustees.

    This Act concerns the distribution of land held in the public trust. The purpose of this Act is to distribute lands held in trust for the people of Pohnpei to beneficiaries of the trust who have entered upon, developed, and possessed such lands for agricultural purposes pursuant to leasehold or other use agreements issued for that purpose by the government of Japan or the Trust Territory Government. The Act sets out criteria and procedures for transfer of title in land.

    This Act aims at conveying title and other interest in land held by the Public Lands Trust Board of Trustees to residential lessees on eligible properties. Lessees eligible to receive title to a residential property shall apply to the Board for transfer. The Act sets out procedural requirements for the application and transfer. Land subject to transfer may not be alienated for a certain period. The Board shall establish Rules and Regulations for the proper administration of provisions of this Act.

    This Chapter establish rules for securing public access to areas that are public lands and that are subject to subdivision into smaller parcels, tracts or lots for sale, lease, homestead, exchange or allocated for any other purposes or any public land abutting the sea or tidal areas that is proposed to be sold, leased, homesteaded , exchanged or allocated. The Board of Trustees shall have the power to promulgate Rules and Regulations, subject to the approval of the Governor, to implement the provisions of this Chapter. Such Rules and Regulations will have the force and effect of law.

    This Chapter confirms, with certain exceptions, law established during the Japanese administration which declared all marine areas below the ordinary high watermark to belong to the government. Certain customary rights to place and maintain fish weirs or traps are re-established. Other exceptions concern customary rights of owners of land abutting the ocean to collect coconuts and other materials and fishing rights on, and in waters over reefs where the general depth of water does not exceed four feet at mean low water.

    This Chapter authorizes the Public Lands Trust Board of Trustees to regulate the removal of mined and dredged materials located on Public Trust Lands in areas listed in this Chapter. Dredging and removal of dredged material at any other site is prohibited. The Chapter sets out conditions for the mining of sand in a specified marine area which shall be monitored by the Environmental Protection Agency and the Division of Forestry and Marine Conservation and establishes certain conditions for mining and dredging in general. A permit for such activities shall be obtained from the Board.

    This Chapter empowers the Public Lands Trust Board of Trustees to sell, lease or dedicate for public purpose specified lands held in trust by the Board for specified purposes. The Chapter specifies for each piece of land conditions or restrictions applying to the power of the Board to sell, lease or dedicate to public purposes such land. The Chapter defines “active use” by the Government. Land shall revert to the Board if such active use of the Government ceases.
