Contemporary discourses on customary land tenure in Africa, and South Africa in particular, have emphasized the socially embedded and flexible nature of customary land rights, recognising these as inherently more ‘pro-poor’ than individual titling. Based on in-depth interviews and participant observations in Venda, a former homeland in South Africa, this paper explores how in the context of expanding commodity frontiers, customary land markets have emerged, leading to de facto privatisation of customary land.

The purpose of this research is to better conserve biodiversity by improving land allocation modeling software. Here we introduce a planning support framework designed to be understood by and useful to land managers, stakeholders, and other decision-makers. With understanding comes trust and engagement, which often yield better implementation of model results.

The Voluntary Guidelines on the Responsible Governance of Tenure (VGGT) call for governments to clearly define the term ‘public purpose’ to allow for judicial review of the goals of expropriations of property. However, recent research indicates that national-level legal frameworks that govern expropriation decision-making not only vary greatly from country to country but also often fail to comply with the VGGT standards on expropriation. This creates the potential for unpredictable and, in some cases, arbitrary applications of expropriation law in practice.

    Landless movement around the world

    Journal Articles & Books
    July, 2008
Africa, South Africa, South America, Brazil

This paper reports on a survey of municipal commonage users, which was undertaken in Philippolis in the southern Free State, in May 2005. The survey showed that a significant number of commonage users are committed to their farming enterprises, as shown by five proxy indicators: Their readiness to plough their income into their farming enterprises; their sale of livestock; their desire for more land, and their willingness to pay rental to secure such land; their desire to farm on their own; and their desire to own their own land.

This paper analyses the shifting role of South African farmers, agribusiness and capital elsewhere in the Southern African region and the rest of the continent. It explores recent trends in this expansion, and investigates the interests and agendas shaping such deals, and the ideologies and discourses of legitimation employed in favour of them. While for the past two decades small numbers of South African farmers have moved to Mozambique, Zambia and several other countries, this trend seems to be undergoing both a quantitative and a qualitative shift.
