    This Law consists of 5 Chapters that contain 26 articles. Chapter 1 lays down the general provisions. Chapter 2 lists the types of activity that are subject to obligatory licensing. Chapter 3 determines licensing for export and import of commodities (produce service). Chapter 4establishes the modalities of issuing licences. Chapter 5 establishes liability for the infringement of the legislation currently in force on licensing.

    Point 26 of the paragraph 1 of the Article 9 is supplemented with the expression "land survey/mapping practices". Point 45 of the paragraph 1 of the Article 9 acquires a new wording. It reads as follows "formal acceptance, storage and processing of cereals and the by-products of their processing at grain-elevators". Paragraph 1 of the Article 12 is supplemented with the following sentence: "Export and import of some commodities (produce and service) are subject to obligatory licensing".

    The President authorizes experimental allotment on unused land and land of marginally profitable or unprofitable agricultural enterprises to citizens on condition of life-long hereditary possession. The aforesaid land shall be used for agricultural purposes. The dimensions of land area shall be established with the consideration of local conditions but shall not exceed 5 hectares for irrigated areas and 15 hectares for non-irrigated areas.

    This Law establishes the forms of property and ownership, legal and economic grounds in the sphere of property relations, and sets forth terms and conditions of the origin of property rights, ensuring protection and conservation of property.     The present Law establishes legal basis of leasehold by foreign states and the amount of rent for foreign land tenure. Object of lease is public land that can be granted on lease to foreign states exclusively on lease (art. 1). Leasehold by foreign states is fixed-date charged land tenure. Area of lease, conditions of lease and the period of lease shall be determined by agreement between the parties (art. 2).

    The Parliament decrees to establish that Land Code shall be applicable to land relations beginning from December 1990, except for land relations envisaged by the articles 37-40 of Land Code to which the provisions of Land Code shall be applicable from 1 January 1991. Citizens who are not workers of agricultural enterprises and legal persons who are provisional tenants of the plots of agricultural land allotted thereto by agricultural enterprises before 1 December 1990 shall maintain the right of land tenure and land ownership.

    Article 24 shall be amended to add the following wording: “Authority carrying out state registration of rights to immovable property and transactions therewith shall submit to the authorized institution for combating the financing of terrorism and legalization of proceeds of crime information on transactions with immovable property”.

    The present Law defines the legal basis for organization and activity of Dehkan farms in the Republic of Tajikistan. The Dehkan farm is an independent managing subject carrying out its activities being not a legal person and based on individual business of a person, or members of the one family and other citizens jointly producing agricultural commodities on the basis of the plot of land and other properties being in its possession.     La présente loi autorise la ratification de la réglementation commune aux Etats membres du CILSS sur l’homologation des pesticides, révisée et adoptée par le Conseil des Ministres du CILSS, le 16 décembre 1999 à N’Djaména (Tchad), dont le but est de mettre en commun (dans un cadre sous-régional de coopération) les expériences et l’expertise des Etats membres pour l’évaluation et l’homologation des pesticides afin d’assurer leur utilisation rationnelle et judicieuse, ainsi que la protection de la santé humaine et de l’environnement.
