    This Act concerns the establishment, functioning, and jurisdiction of the Land Tribunal. The Tribunal may consist of one or more divisions as the Minister may consider necessary to constitute, each headed by a Land Tribunal President. The Minister shall appoint the Chief Land Tribunal President. A Land Tribunal shall have jurisdiction to - (a) hear and determine a land dispute brought to its attention; (b) hear appeals and review decision of a public body concerning land.

    This Act makes provision with respect to the recognition of tribes and certain matters regarding the administration of tribes, i.e. the institution of traditional leadership by a person designated by the tribe and recognized by the Minister.The Act, among other things, sets out the procedures for the designation and recognition of traditional leaders, provides for appeal against decisions of the Minister, defines the functions of traditional leaders, defines the jurisdiction of courts in matters of administration of tribes and defines regulation-making powers of the Minister.

    La présente loi autorise la ratification de la réglementation commune aux Etats membres du CILSS sur l’homologation des pesticides, révisée et adoptée par le Conseil des Ministres du CILSS, le 16 décembre 1999 à N’Djaména (Tchad), dont le but est de mettre en commun (dans un cadre sous-régional de coopération) les expériences et l’expertise des Etats membres pour l’évaluation et l’homologation des pesticides afin d’assurer leur utilisation rationnelle et judicieuse, ainsi que la protection de la santé humaine et de l’environnement.

    This Act provides for the granting of various rights relative to prospecting and mining of minerals, for environmental obligations related to mining operations and other duties of persons carrying out mining operations, and control of mining operations. “Minerals” is defined so as to exclude petroleum ,as defined in section 2 of the Petroleum (Exploration and Production) Act, and public and private water when used for a primary, secondary or tertiary use, as defined in the Water Act.

    This Act makes provision for matters of partition in the relation with the development of land.It defines sectional ownership of immovable property and provides rules relative to common ownership. Development schemes shall be approved by the Director of Surveys and Mapping. The Act further provides for, among other things, formation of associations that shall govern a development scheme and common property, registration of rights and exclusive use of common properties and servitudes.

    The definition of “tribal territory” is erased from section 2 and instead a definition of “tribal area” is given. Such area has the same meaning as in the Tribal Land Act. Section 71 is amended consequently. The clause of section 13 which prohibits issue of a reconnaissance permit in respect of an area on which a prospecting licence or mining lease is in existence is deleted.

    The Act consists of 43 sections divided into 6 Parts: Preliminary (I); Central administration (II); Development Plans (III); Control of development of land and permission for development (VI); Subdivisions (V); Supplemental (VI).The Minister shall be responsible for a comprehensive policy with respect to use and development of all land in Botswana and in accordance with Development Plans made under Part III (sect. 3). The Minister may declare Planning Areas under section 4 and provisions of this Act shall apply to such areas.

    This Act provides rules for public procurement and the disposal of public assets including land.The Act prescribes that a local authority shall be responsible for the management of all procurement and disposal activities within its jurisdiction in accordance with the provisions of this Act. There is hereby established for each local authority a Performance Monitoring Committee, which shall monitor and review the management of all procurement and disposal activities by a local authority.
