    Montserrat

    This Act concerns control of holding of interests in land in Montserrat by foreigners, i.e. persons other than a person belonging to Montserrat (as defined in section 2(2)(b) of the Immigration Act). Subject to the provisions of this Act, neither land in Montserrat nor a mortgage on land in Montserrat shall, be held by a person not belonging to Montserrat, and any land or mortgage so held shall be forfeited to Her Majesty.

    This Ordinance provides with respect to land title surveys in the Islands. Persons that carry out a survey shall be an surveyor authorised under this Ordinance by the Governor. Any surveyor working for the government shall be deemed to be authorised as long as he or she is employed by the government. The Governor may from time to time order public surveys. The Ordinance also provides for powers of authorised surveyors, compensation of damage done during survey and regulation-making powers of the Governor.

    This Act concerns the development and management of geothermal resources for purposes of obtaining geothermal energy. It establishes the Geothermal Resources Advisory Committee. “Geothermal energy” means the energy derived or derivable from and produced within the earth by natural heat phenomena, and includes geothermal water. The Geothermal Resources Advisory Committee shall advise the Minister on development of geothermal energy.

    This Act amends the Property Tax Act by repealing and replacing the First Schedule, which specifies the rates of tax for various kinds of properties. It also amends the Registration (Strata Titles) Act in section 19 on the total unimproved value of the parcel as apportioned by the unit entitlement of the strata lot.

The objects of this Act are to promote— (a) the principles of accountability, integrity, transparency and value for money; (b) efficiency, fairness, equity and public confidence; and (c) local industry development, sustainable procurement and sustainable development, in public procurement and the disposal of public property. “Public property” means real or personal property owned by a public body.

It also inserts a new Part (VIa) on the disposal of state land, which may be subject to regulations made by the Minister, the State Lands Act notwithstanding.

The Act also amends the principal Act in Part V by deleting the heading “Division 5 - Easements, Restrictive Agreements, Profits and Licences” and substituting the following heading “Division 5 - Easements, Positive and Restrictive Covenants, Profits and Licences” and by replacing section 93 on validity and enforcement of registered positive covenants and restrictive covenants.
