    The present Law lays down provisions relating to the right of wood and pasture exploitation in the Region of Carinthia. The text consists of 63 articles divided into 9 chapters as follows: General provisions (I); New regulation and regulation of traditional rights (II); Transfer of exploitation rights (III); Safeguard of rights of use (IV); Basic rights of wood cutting in case of need (V); Special field services (VI); Authorities and proceedings (VII); Penalties (VIII).

    According to article 91a, paragraph 1, of the German Constitution (Grundgesetz) measures on the improvement of production methods, working conditions, management and in general in the agricultural, fishery, forestry and water sector shall be taken with the agreement of regional governments. For this purpose a common frame work is devised and every year within the 1 March the Länder submit a general working plan to the Federal Minister for Nutrition, Agriculture and Forestry for approvement within the said frame work. The Act consists of 14 articles.

    An Act to set new environmental policy standards by giving water and soil associations new rural management duties. Moreover, associations can promote cooperation between water management and agriculture while further developing the protection of water, soil and nature. Finally, the associations can be assigned tasks within the framework of set-aside land. The Act grants the associations a far-reaching right to self-administration as, for instance, the power to issue by-laws; furthermore, association may be established also by a decision of its members and not only ex-officio.

    The present Law introduces some amendments to the Carinthia Wood and Pasture Exploitation Law (LGBl. No. 15/22003). In particular, the Law amends, inter alia, article 3 dealing with authorizations; article 17 concerning the environmental ombudsman; article 18 regarding the environmental impact assessment; article 24 on compensation payments; and article 61 on implementation of Community Law.
