The scope of this Law shall be to prevent speculation in agricultural land and preserve traditional forms of farming; to create conditions for the formation of rational land holdings and land consolidation; and to promote the rational use of agricultural land. It shall not be applicable to agricultural land of subsistence farming, land used for horticulture and gardening, and inherited land and land owned by the way of restoration of legal rights of ownership.

Article 7 shall be amended to add the following wording: “By Government resolutions, state forest land plots may be transferred by the right of trust to perform state functions specified by the Forest Law Act. State land plots may be transferred by the Government resolutions by the right of trust and to other entities specified in the Law on the Management, Use and Disposition of State and Municipal Property in the Law, when the law assigns them state functions.”

This Law aims at transforming the system of public landownership into private property ownership. It is structured as follows: Chapter 1 (General provisions). Article 1 provides that the right of ownership shall be restored either by restitution of the actual property or through financial compensation. It also establishes terms, conditions and restrictions on the purchase of land by foreigners. The Act consists of four Chapters divided into 17 Articles: (1) general provisions; (2) right of foreigners to purchase land, internal water and forest; (3) temporary provisions regarding the right of foreigners to purchase non-agricultural land; and (4) final provisions.

This Act shall not be applicable to purchase of land in the gardening associations. The following categories of land managers shall have the state support in the form of instalment selling of the public land for the period of 15 years: (a) natural persons registered as farmers; and (b) legal persons manufacturing agricultural commodities annual sale proceeds of which exceeds 50 percent of annual income thereof.

The purpose of the Law is to establish privatisation of the state-owned and municipal property for cash. Privatisation objects may be transferred into private ownership only in compliance with this Law. Shares and other property owned by the state or municipalities may be transferred into the ownership of other persons only under this Law, unless other laws provide otherwise.The State Property Fund is designated as the lead agency for privatisation.
