    The present Act provides for the Reconciliation, Settlement and Benefits Agreement between the Province and the Musqueam Indian Band. Furthermore, the Act vests ownership of some parcels of land from Pacific Spirit Regional Park to the Musqueam and addresses a number of other features, such as land-use terms, covenants, and zoning to allow for residential multi-family development on one of the parcels.

    The aim of this Act is to protect "agricultural land reserves", as established under the Agricultural Land Commission Act. It is based upon a basic prohibition to either remove soil or bring any material onto agricultural land reserves, unless accompanied by a local authority permit, or by the written approval of the Provincial Agricultural Land Commission (sect. 2). The remaining sections deal with application fees (sect. 4); permits (sect. 5); suspension and cancellation of permits (sect. 6); enforcement (sects. 8 and 9); offences (sect. 10); regulations (sect. 11).

    This Act provides for the creation of a Commissioner on Resources and Environment responsible before the Cabinet (Executive Council) and who's role is fundamentally to advise on and develop a strategy for land use and related resource and environmental issues and on the need for legislation, policies and practices respecting these issues. The Commissioner also has coordination and monitoring duties and must take the interests of individuals, groups and Aboriginal peoples into account (sects. 3 and 4).

    This Act provides for the continuation of the Provincial Agricultural Land Commission as a government corporation appointed by the Lieutenant Governor in Council (LGC) (sect. 2). Its principal objects and powers are to preserve agricultural land, encourage the establishment and maintenance of farms, assist local government in the preparation of land reserve plans required under this Act, encourage the support of farm use of agricultural land generally. It has the power to designate agricultural land reserves for the above purposes (sect. 11).

    This Act gives the power to "regional and district managers" to grant rights over Crown range in the form of grazing licences, grazing permits, temporary grazing permits, hay cutting licences and hay cutting permits (sect. 3). Crown range means land included within the boundaries of a range district as established under this Act, but does not include land that is subject to a lease issued under the Land Act (sect. 1). Procedures for applications and fees are spelled out in sections 10-19. Section 14(1) and 14(2) deal with direct awards of licences or permits.

    This Act regulates the creation of Regional Park Districts. Article 2 states that, upon receipt of a petition from the councils, trustees, or both, of two or more municipalities, the Lieutenant Governor in Council may, on the recommendation of the minister, incorporate the area of land within the boundaries of the municipalities and its residents, into a regional park district.

    The present Act implements commitments set out in the Kunst’aa Guu – Kunst’aayah Reconciliation Protocol between the Province and the Haida Nation, which was signed 11 December 2009. The decision-making framework provides for the establishment of a Management Council made up of two appointees by each of the Haida Nation and the Province under their respective authorities, as well as a jointly appointed Chair.
