    This case study presents the unique example of pastoralist communities in Kenya who had traditionally been able to rely on their customary land governance systems to ensure their access to grazing land and to help them sustain their livelihoods in the face of drought. However, land laws that were passed by the colonial and post-colonial administrations in Kenya progressively replaced customary structures and practices with artificial formal/legal structures that bore no connection to the communities’ customs.

    Over the last 50 years, most Asian countries have gone through a shift from subsistence agricultural systems to industrialized economies. In Indonesia, the major shift came in 1966, when General Suharto successfully staged a military coup. Under his presidency, Indonesia experienced the “New Order”. A key aspect of this regime was trade and industrial expansion. Changes were made to foreign and domestic investment laws to facilitate growth, including the removal of most controls on private investments.

Namati has developed a comprehensive, five-part approach that supports communities to: build unity and internal capacity for community land protection, proactively document and map their land claims, strengthen local governance, seek formal government recognition of their land rights, and plan for their own flourishing future.

    In Liberia it is estimated that around half the country’s land mass has been promised to foreign companies and investors. From 2009-11 the Sustainable Development Institute and NAMATI embarked on an action research project to support rural communities to protect, document, and manage their customary lands and natural resources. Drawing from lessons learned in the field, they sought to bring the voices and realities from rural Liberia to influential policymakers.
