The approval by the public of the Constitution at the referendum on August 4, 2010 and its promulgation on August 27, 2010 heralded a new dawn of governance in Kenya.     These Rules amend the Registered Land Rules in the Third Schedule. The Third Schedule prescribes forms for purposes of the Registered Land Act. Form R.L. 2 is amended by deleting the attestation clause and substituting therefore a new clause. This form concerns the transfer of a lease.

    The Act makes amendments of miscellaneous character to the Registered Land Act consequential to the enactment of the Customary land Act, 2016 and the Land Act, 2016. Amendments concern, among other things, land survey and registration bodies, registration of customary estate or lease of customary land, charges, and acquisition of easements and profits by prescription in respect of customary land.

    These Regulations of the Cabinet Secretary implement provisions of the Land Registration Act in respect of the organization and administration of land registries, the procedures for the registration of land, and related matters. The land register referred to under section 7 of the Act shall contain (a) the property section; (b) the proprietorship section; and (c) the encumbrance section. The Regulations set out the content of each section and also of the proprietorship section of a register that pertains to community land.
