Why this study?
Recent years have witnessed an increase in violent conflicts involving pastoralists in parts of West Africa and the Sahel. They often take the form of clashes between herders and farmers, impacting human, national and regional security.
Given its mandate and role in conflict prevention, the United Nations Office for West Africa and the Sahel, in collaboration with the Economic Community of West African States, initiated this study in 2017 to examine the causes and identify concrete solutions to conflicts related to pastoralism.
A local famer-herder conflict over grazing rights in the Mauritanian-Senegal border region has triggered a spiral of violence between Senegalese and Mauritanians in the southern Senegal River bank and different Mauritanian cities. The recent spate of violence mostly in north-central and southern Nigeria, typically credited to conflicts between herders and farmers, and the reactions, narratives, and representations that have attended them, calls for an examination of core security questions: who or what is to be secured, from what threat and by what means. In fact, it could be further contextualized as: how is the conflict between farmers and herders constructed, framed, and represented as (in)security within the Nigerian context?
Nigeria’s arid North West is beset by violence between herders and farmers, which has been compounded by an explosion in criminal activity and infiltration by jihadist groups into the region. The last decade has seen thousands of people killed and hundreds of thousands displaced, with many fleeing into Niger Republic next door. State-level peace efforts with several armed factions have had some success, but these will not prove durable unless more actors lay down their weapons.
This paper considers possible answers to these difficult questions by focusing on two issues: the evolution of legal norms in response to both endogenous and exogenous changes, and the role that African customary law and indigenous dispute resolution has played in promoting coordination and cooperation among group members, thereby reducing violent conflict. This paper explores legislative actions taken by the Nigerian government that impede the continued evolution of these relatively elastic customary legal norms.

This paper explores the role of Manhyia Palace, a traditional political office of the Asantehene (King of Asante Kingdom) in traditional land conflict management in Kumasi. Land conflicts remain a major hindrance to land use and tenure security in most parts of Ghana. Sometimes, the institutions governing land use and management are crucial to the occurrence and adjudication of these disputes. Consequently, statistics at the Accra High Court Registry shows that, land litigation ranks first in the number of cases pending with about 60,000 cases being registered in the superior courts.
