    This Act provides rules for the prospecting for and mining of minerals specified in the First Schedule to this Act. Save to the extent provided for in this Act, it shall not apply to matters relating to petroleum and hydrocarbon gases. The Cabinet Secretary responsible for mining, the Principal Secretary of the responsible ministry and any person shall be guided by the values and principles enshrined in the Constitution and in particular Articles 10, 66 (2), 201 (c) and (d), and 232 of the Constitution and the principles of leadership and integrity.

    This Act makes provision for a wide variety of matters relating to land tenure and reform in Lesotho including the definition of rights in land, allocation of land in rural areas, grant of title in land, vesting of land in authorities, government acquisitions and acquisition and expropriation of land for public purpose, grant of long-term leases and regularization and adjudication of title in land, including resolution of disputes by specialized land courts established under this Act. All land in Lesotho is vested in the Basotho Nation and is held in trust by the King.

    Section 2 defines the land to which the provisions of this Act apply. The provisions of the Subdivision of Agricultural Land Act, 1970 shall not apply to land on which a development is undertaken in terms of this Act. Consent to an occupier (defined in section 3) to reside on or use land shall only be terminated and the occupier evicted in accordance with conditions set out in section 8. Rights and duties of an occupier are defined in section 6. Section 7 concerns the impounding of animals.
