The first part of the paper briefly reviews the construction of customary tenure and the historical phases of administrative interventions into land tenure, and considers their heritage in contemporary situations.

This study explores the impact of changes in land tenure institutions on women's land rights and the efficiency of tree resource management in Western Ghana. We find that customary land tenure institutions have evolved toward individualized systems to provide incentives to invest in tree planting. However, contrary to the common belief that individualization of land tenure weakens women's land rights, these have been strengthened through inter vivos gifts and the practice of the Intestate Succession Law.

Ownership is the tenure form in most of these housing projects. Under ownership the law only recognises registered land transactions. Non-government tenure administration in Dunoon was organised by street and area committees that are part of the local South African National Civics Association (SANCO) branch, a community based organisation (CBO).

Following this trend, land reform policy in Ghana was based on a pluralistic legal system in which both the customary land tenure system and the statutory system of land ownership and control co-exist by law. The primary research question for this study was the following: What implications emerge when customary land tenure system and the statutory system of land ownership and control co-exist in law?
