    The former socialist countries of Eastern Europe (that is, Europe east of Germany and west of the Urals, but including all of Russia) began a transition to a market economy in the late 1980’s and early 1990’s. This paper looks at one aspect of that transition: the transition from state ownership to private ownership of agricultural land and the accompanying transition to a land market for agricultural land.

    This Land Code establishes that objects of land relations shall be: (a) land; (b) plots of land; (c) land rights; and (d) restrictions (encumbrances), including servitude. The following types of ownership are envisaged: (a) public property; (b) private property; (c) foreign property, including property of international organizations; (d) lifelong hereditary ownership; (e) open-ended (permanent) ownership; (f) provisional ownership; and (g) lease (sublease).

    This Presidential Decree regulates the transfer of land owned by legal persons, including enterprises with foreign investments. It does not apply to non-residents. Transfers of land shall be carried out for payment by decision of the President. Proceeds from sale of land shall be used for soil conservation, improvement of soil fertility and land surveys.

    The Presidential Decree stipulates that plots of public land shall be transferred to citizens for private ownership according to their cadastre value, except for plots transferred at a preferential price or by auction for individual construction.

    Repealed by: Presidential Decree No. 667 regarding expropriation and allotment of land plots. (2007-12-27)

    This Decree establishes the modalities of organization and conduct of electronic auctions for sale of public plots of land and the right of the conclusion of lease contracts related to public land plots destined for sale for residential housing construction and lease contracts for servicing thereof. Seller of public land plots shall be state legal person and seller of the right of lease of public land plots shall be lease provider. Organizer of electronic auctions shall supply clients with all the necessary information related to auction sales.

    This Decree establishes the modalities of transfer of typical and (or) rare natural landscapes and biotopes under protection of the owners of land plots and (or) waterbodies, forms of certificates of the aforesaid landscapes and biotopes and conservation pledge agreement, and terms and conditions of the issuance thereof. Identification of typical and (or) rare natural landscapes and biotopes shall be performed by specialized and authorized legal person in the process of performing scientific research or monitoring of vegetation.

Basic annual rates of public land shall be set by local self-government with the consideration of cadastre valuation of the plots of land and with the application of factors established by the President of Belarus subject to the purposeful use of land.

    The President establishes that basic annual rates of rent for lease of public land shall be fixed by local self-government with the application of factors depending on the purposeful use of land. The purposeful use of land shall be classified as agricultural land, urban land and industrial land. Local self-government shall be granted the right to double or to halve basic annual rates of rent depending upon lease period and land reclamation carried out by the lessees of the aforesaid land.
