The former socialist countries of Eastern Europe (that is, Europe east of Germany and west of the Urals, but including all of Russia) began a transition to a market economy in the late 1980’s and early 1990’s. This paper looks at one aspect of that transition: the transition from state ownership to private ownership of agricultural land and the accompanying transition to a land market for agricultural land.

The Food and Agriculture Organization of the United Nations and its partners will hold consultations on various issues relating to the voluntary guidelines on responsible governance of tenure of land and other natural resources. The voluntary guidelines aim to provide practical guidance for State governance bodies, civil society and the private sector. The voluntary guidelines will provide a basis, which interested parties can use when developing their strategies and activities.

This Governmental Decree regards auction sale of the rights to use land plots of the Land Reallocation Fund at the Ministry of Agriculture and Water Resources of the Kyrgyz Republic consisting of irrigated and dry arable land, lands with perennial plantations, hay lands and lands requiring reclamation shall be conducted with a view to promote market and land relations and increase the efficiency of land use.

This Law regulates legal relations in administration of agricultural land and aims at promotion of efficient and safe use of land in the interests of the people of the Kyrgyz Republic. Land is a national treasure of the Kyrgyz Republic and the property of the people, which lives on its territory. (art. 5). The State and exclusively citizens of the Kyrgyz Republic who permanently reside in rural location for at least two years have the ownership right to agricultural land in the Kyrgyz Republic (art. 6).

Land legislation shall be based on the principles set out in article 3. In accordance with the Constitution of the Kyrgyz Republic, land may be the state, communal, private or other forms of ownership (art. 4). Article 4 also defines state lands and communal ownership. Article 5 concerns rights of foreigners to use land. Transactions with rights to a land plot shall be subject to state registration and shall not require notarization, except for the cases provided by law (art. 9). Article 10 defines the Land Fund of the Kyrgyz Republic.

Land plots of the Agricultural Land Redistribution Fund are allocated for the establishment of new and operation of existing seed-growing, livestock-breeding, testing and selecting, experimental farms and state variety testing enterprises that are included into the list approved by the Decree of the Government dated October 4, 1994, No. 745, under condition of implementation of a thorough reform and maintenance of their specialisation in the field of livestock-breeding and seed-growing business.

Allocation of land from the Agricultural Land Redistribution Fund for the expansion of the territories of rural settlements is performed by the Ministry of Agriculture and Food in collaboration with the Ministry of Architecture and Construction, State Agency of Land Management and Land Resources under the Government of the Kyrgyz Republic and in agreement with the local state administrations. A special commission set up by the rayon state administration considers Land for the expansion of each specific rural settlement. That Commission considers also land planning issues.

This Decree contains a series of considerations and rules pertinent to land and agrarian reform and the allocation of land shares to citizens living and working in rural areas in kolkhozes and sovkhozes. Tasks of central and local authorities in this respect are formulated. It is determined that the citizens of the Kyrghyz Republic and legal persons of the Kyrgyz Republic enjoy the right to use land shares and sale, exchange, inherit, use as a collateral, rent this right to use land share. The setting up of a land reallocation fund is considered and exchange of land provided for.
