This is a regional overview of the main legal and regulatory questions concerning ownership or access to and management of land-based natural resources. The paper documents how the implementation of the land tenure policy of the Vietnamese government has affected the agricultural system, livelihood strategies and food self-sufficiency of Thai farmers in a remote upland village, Que, in Nghe An Province, North Central Vietnam. It is shown that the enforcement of restrictions on the area under swidden agriculture has resulted in a strong reduction of swidden agriculture production and shortened fallow periods, not compensated for by the slow increase in paddy rice production.

SUMMARY: Despite a centralized political system, nation-wide legal reforms, and similar high housing demand pressures, property rights have evolved differently in Vietnam’s two leading cities Hanoi and Ho Chi Minh City during the transition period. Using ethnographic fieldwork and a hedonic price model, the study shows that the two land and housing markets price tenure ambiguity differently. The different price structures indicate the importance of norms, as socially constructed by local political interests and culture, in the efficacy of land title regularization programs.
