Agricultural land is allocated to specified subjects whose main source of income is agriculture, aquaculture of the winning of salt. Article 2 defines "agricultural land". Land shall be allocated for 20 years if used for planting of "annual trees" or aquaculture and 50 years if used for planting of "perennial trees". Article 5 specifies how much land can be allocated, depending on where the land is situated. Article 15 concerns the management of public land.

The Decree provides the regulation for redistribution of abandoned, denuded, mountainous lands or uncultivated lands to households and families in order to increase their agricultural productions. Households and families shall be assigned with those lands the right to use them and cultivate them.

The Decree provides the allotment of state-owned land destined to planting of perennial trees, seasonal crops and forestation, plus the water surface required for aquaculture farming to individuals, households and organizations which shall invest in the resulting production. This Circular, consisting of guides the formulation and approval of plans to use the top soil of wet-rice farm land when it is used for another purpose, to improve poor-quality rice farm land and other arable land; and plans to reclaim, restore and improve other rice farm land to offset the area of wet-rice farm land used for another purpose under competent authorities' land allocation or lease decisions. Domestic and foreign organizations and persons (investors) allocated or leased by the State wet-rice firm land for non-agricultural use.

This Decree provides for the exemption from the agricultural land use tax in case of land assigned by the State to households and individuals for agricultural development, or belonging to farmer cooperatives whose land has been assigned for agricultural production, or for agricultural and forestry farmers which have been assigned lands for farming, in poor and less favoured areas.
