    Benin introduced new instruments to register customary land rights in the 2013 Land and Domain Law, which was updated in 2017. The BMZ supported “Promotion d’une Politique Foncière Responsable (ProPFR)” project is testing these instruments together with scalable implementation modalities in the Borgou department (Benin). This work is complemented with a rigorous impact evaluation to assess changes in tenure security, agricultural investments and food security. The baseline survey was completed in 2018 and includes 2,968 households in 53 villages in the Borgou.

On the contrary, recent studies show that many rural Africans live in increasingly densely populated areas where all arable land is allocated or under cultivation.     DFID are looking to propose that the UK supports a package of measures to strengthen land transparency and ultimately governance. This work is of a high priority for DFID and the wider UK Government. Following further research on the evidence and internal discussions, DFID have identified a gap relating to two specific questions:

    1.    What are the impacts of large-scale land acquisitions (LSA) on local food insecurity and malnutrition levels? 
    2.    Is there a difference in impacts whether investments are international or local?

The study specifically focused on tenurial arrangements and land transactions in the region.     The Lao Land and Forest Allocation Policy (LFAP) was intended to provide clearer property rights for swidden farmers living in mountainous areas. These lands are legally defined as “State” forests but are under various forms of customary tenure. The policy involves demarcating village territorial boundaries, ecological zoning of lands within village territories, and finally allocating a limited number of individual land parcels to specific households for farming.

    In Kenya, insecure land tenure and inequitable access to land, forest and water resources have contributed to conflict and violence, which has in turn exacerbated food insecurity. To address these interlinked problems, a new set of laws and policies on food security and land governance are currently being introduced or designed by the Government of Kenya. The new Food Security Bill explicitly recognizes the link between food security and land access, and the 2012 land laws target the corrupt system of land administration that made much of Kenya’s land grabbing possible.

    The first set of the land laws were enacted in 2012 in line with the timelines outlined in the Constitution of Kenya 2010. In keeping with the spirit of the constitution, the Land Act, Land Registration Act and the national Land Commission Act respond to the requirements of Articles 60, 61, 62, 67 & 68 of the Constitution. The National Land Policy, which was passed as Sessional Paper No. 3 of 2009, arrived earlier than the Constitution, with some radical proposals on the land Management.

    In Kenya, insecure land tenure and inequitable access to land and natural resources have contributed to conflict and violence, which has in return exacerbated food insecurity. Most farmers in Kenya have no legal title for the land on which they farm. Sources of tenure insecurity can be ethnic conflicts over land between neighbouring communities, particularly in the Northern provinces, expropriation by the state or local government and land grabbing by local elite or companies. Competition is as well growing over water, especially over groundwater, which is scarce in Kenya.
