Applying a Rights Perspective

This report brings together four studies that evaluate regulatory initiatives with implications for forest-dependent communities from a rights-based perspective. These are: The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 – India; Regulatory initiatives and selected outcomes of judicial processes in Malaysia; The Community Forest Act (2007) – Thailand; and The Indigenous People’s Rights Act (1997) – Philippines. Each study covers law making, content and implementation.

This paper presents case studies of two tribal villages - Mendha Lekha and Jamguda - successfully running forest-based bamboo businesses under the community forest rights provisions of Forest Rights Act (2006). We have documented the issues faced by the villagers in claiming community forest rights, issues faced in harvesting and sale of bamboo, and business practices adopted by both the villages.

Pathways for Sustainable Forest Management and Socio-equitable Economic Development
The Bhutan Forest Note articulates opportunities for supporting Bhutan's sustainable development aspirations, including its constitutional commitment to maintain at least 60 percent of the country's land area under forest cover and to better respond or prepare for vulnerabilities such as climate change and natural disasters. The note presents a forward-looking business case for Bhutan to support an increase in forest utilization without jeopardizing the integrity of forest and non-forest ecosystems.

At the request of the Sri Lankan Government an assessment was designed and conducted as part of the development of the country’s national strategy on REDD+. The assessment involved applying criteria from the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries, and Forests (VGGT) to analyze the tenure implications for a wide array of proposed policies and measures (PAMs) to address deforestation and forest degradation. The assessment will help Sri Lanka to prioritize and make investment decisions among the PAMs.

The objective of the India Ecosystem Services Project (ESIP), which is under preparation, is to improve forest quality, land management, and nontimber forest produce (NTFP) benefits for forest dependent communities in selected landscapes in Madhya Pradesh and Chhattisgarh. The Ministry of Tribal Affairs, Government of India enacted the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, a tribal friendly legislation to address the historical injustice and critical issues, pertaining to the forest rights deprivation of the Forest Dwellers. To facilitate its implementation, FRA Rules, 2008 was framed and then made amendment to the Rules in 2012. However, several constraining factors and issues came to the notice in the implementation process of the Act in letter and spirit.
