    Factors and actors driving the reform agenda

    This paper examines the roles of the state, international organisations and the public in pastoral land reform in the Central Asian republics and Mongolia. In recent years new legislation has been passed in most of these countries, often driven by environmental concerns. In the development of these laws, international organisations tend to promote common property regimes, whilst governments usually emphasise individual security of tenure, each using environmental arguments taken from quite different bodies of theory.

    In many countries, pastoralism has historically been practiced in areas that are now partitioned by international boundaries. This is a major barrier to sustainable resource management and to pastoral development. However, there are examples from around the world of efforts to facilitate transboundary movements and transboundary ecosystem management by pastoralists. This report examines how pastoral mobility has been impacted by the creation of unnatural boundaries within their landscapes and how societies cope with these constraints through legal or informal arrangements.

    The relations in the sphere of the rights to use pastures on the territory of the Kyrghyz Republic shall be regulated by this Law, the Forest, Water and Land Codes, laws on lease and lease relations, protection of the nature, flora and fauna, atmospheric air and other legislation of the Kyrghyz Republic. The subjects for the utilization of pastures shall be juridical and natural persons. The objects shall be certain areas of pastures. The pasture areas shall have locations and boundaries both on the map and on the ground.

    Kyrgyz pastureland make up the majority of land mass in the country and are an important resource for most rural people, providing good opportunities for economic growth and poverty reduction. Kyrgyz pastureland reforms devolved management of pastures to local level pasture committees. This case study looks at promising practices and lessons learned from an intervention related to those reforms, that seeking to both promote community management of pasturelands and also promote the interests of women within those communities.

    This paper represents part of an area of work which analyses the linkages between rights to land and water. An initial scoping paper explored the interface between land and water rights (LSP Working Paper 10: Hodgson, S. (2004). “Land and water – the rights interface”). It is complemented by two regional analyses: this Working Paper and LSP Working Paper 25: IIED. (2006). “Land and water rights in the Sahel: Tenure challenges of improving access to water for agriculture”.

    This Governmental Decree establishes the procedure for application of payment of fees for use of pastures (except for grazing in public forest and in protected areas) pertaining to state ownership. The scope shall be to form standard approach in fixing payment of fees for use of pastures depending upon the number of livestock and animal species authorized for grazing. The mount of fees shall be fixed annually with the consideration of optimal pressure upon a unit of pasture. Annual grazing plans shall be validated by local government.

    This Ministerial Decree establishes the modalities of the use of pastures and grazing resources for the purposes not related to grazing of cattle. It specifies that local authorities shall be granted the right to allocate pastures and grazing resources for payment in accordance with contracts for use of pastures and grazing resources for purposes not related to grazing of cattle. The right of use of pastures for the period of over three years shall be subject to compulsory state registration.

    The overarching goal of this study was to understand the bottlenecks and the incentives present in forest management in the Kyrgyz Republic. The study focused on the legal, policy, social, institutional, and governance constraints that prevent rural communities living within and around forest lands from increasing the benefits they derive from the use of forest resources, while preserving fragile forest ecosystems.
