    Across Africa, Asia and Latin America, investors are increasingly approaching rural communities seeking land for logging, mining, and agribusiness ventures. Even in those situations where the investors have followed FPIC guidelines and undertaken a formal “consultation” with the community, these consultations are generally conducted in a context of significant power and information asymmetries. Part of the power imbalance comes from communities’ lack of information about the value of community lands and natural resources.

    In recent years, local people and rural communities have assumed increasing prominence in strategies for natural resource management.This paper briefly reviews some of the central legal issues that are associated with this shift. In doing so, its goals are limited. It does not ad dress fundamental questions about when, where and what kind of management works, nor attempt to identify the political, social, economic and environmental ingredient s for success – subjects on which there is a huge, if still inconclusive, literature.

    Women and childrens' insecure rights to property and inheritance in many countries in sub-Saharan Africa is not a new issue. The extended family support systems that used to function as social safety nets for widows and orphaned children have weakened as a consequence of societal changes such as economic development, migration and urbanization. This situation has clearly been exacerbated by the AIDS epidemic. Though prevalence is starting to level off, or even decline, in several high prevalence countries, this comes after years of increasing prevalence.

    Land Tenure Working Paper 11. This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

    Land lies at the heart of social, political and economic life in much of rural Africa. It provides a major source of livelihoods, income and employment; a basis for social and political relations; and has major historical, cultural and spiritual significance. In many places, rapid socio-economic changes are undermining the security of land access for poorer and more vulnerable groups – particularly in high-value lands such as peri-urban areas, irrigated schemes and fertile lands.

En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas.     Given the recent trend of granting vast areas of African land to foreign investors, the urgency of placing real ownership in the hands of the people living and making their livelihood upon lands held according to custom cannot be overstated. This study provides guidance on how best to recognize and protect the land rights of the rural poor. Protecting and enforcing the land rights of rural Africans may be best done by passing laws that elevate existing customary land rights up into nations' formal legal frameworks thereby making customary land rights equal to documented land claims.

Section 2 will describe the main features of the sustainable livelihoods approaches and relate them to current thinking about access to natural resources. Section 3 will describe and categorise the different types of problems and opportunities that the rural poor face with respect to access to natural resources.
