    Across Africa, Asia and Latin America, investors are increasingly approaching rural communities seeking land for logging, mining, and agribusiness ventures. Even in those situations where the investors have followed FPIC guidelines and undertaken a formal “consultation” with the community, these consultations are generally conducted in a context of significant power and information asymmetries. Part of the power imbalance comes from communities’ lack of information about the value of community lands and natural resources.

    Abstract: In this paper, the context within which the National Land Policy ascribes to tackle gender issues and specially provide for entrenchment, opportunity and strengthening of women’s land rights is analyzed. In the first part acknowledgement of influencing context conditions that refine gender issues are detailed these include; the nature of women’s rights, position of women given their transient rights, the consequences of gender inequality on land and the effect of dispute resolution on land matters.

    This is a qualitative study of community-based legal aid programs in Uganda and Tanzania. It assesses the efficacy of legal aid activities, the challenges faced by implementing organizations, and it documents opportunities and potential for scaling–up. It finds that legal aid activities will only be successful if they also succeed at changing the mindsets and attitudes surrounding women’s rights, and that further impact evaluation should be done to determine how to improve activities.
