Land corruption – corrupt practices in the land sector – threatens the lives and livelihoods of people and communities, the environment and climate, food security and political stability. Addressing it requires a dedicated focus and assessment of land related institutions across different national contexts.

How these claims are framed, analysed, and governed, how access to land is organised, and who gets a seat at the table to discuss key decisions are questions of urgent concern from both a fair transitions perspective and a land governance perspective. An important part of a land administration system that is aimed at constantly reflecting the current right holders of the land and supporting the real estate market, is the system behind the registration of rights, restrictions and responsibilities. Over time the way land transactions have been evidenced, moved from oral agreements, via private conveyancing to registration of deeds, and ultimately registration of title (Larsson 1991).

From colonial to modern times, Brazilian agricultural property has remained immersed in a chaotic vortex of deregulation. Attempts of institutional reform - such as the Lei de Terras (Land Law) of 1850 - have been largely unsuccessful, whilst providing legal grounds for land grab by large estates and narrowing the scope of possibilities open for legitimate reevaluations of the first institutional landmark on land use and ownership in the country - the sesmarias.

Brazil has, on the one hand, strong institutions in various areas, improved social situation and, on the other, the rural land situation is still very precarious, with basic unresolved questions, such as for example, knowledge of what is public and private land, due to the absence of cadaster. The legislation moved forward in an attempt to link the cadasters of INCRA, the Internal Revenue Service, with information from the Registry of Real Estate with the enactment of Law No. 10,267 / 2001, creating the National Register of Rural Properties – CNIR.

Internationally there are an alarming number of violations of indigenous peoples’ land and human rights. Brazil is currently under the spotlight as the heightening of the political crisis that led to the impeachment of Dilma Rousseff brings national and international concerns over the uncertainty related to changes in policy that may be adopted by the interim Government in relation to indigenous peoples land rights.
