    South Africa

This article discusses the implication of the 2021 CASAC v Ingonyama Trust judgment on South Africa’s land governance policy trajectories. It explores the extent to which there are missing links between policy imperatives, the legal system, court processes and socio-economic emancipation. It argues that the failure of the state in policy design and implementation has turned courts into contradictory sites of struggle for emancipating land rights.

Fair Transitions and the Politics of Land.

Institutions and Imaginaries for Inclusive Futures

    Global

Questions about how land is governed and controlled in the context of multiple crises are key to debates about fair transitions. The energy transition, net-zero ambitions, nature protection, and food system transformation all involve claims on land, water, and forests. How these claims are framed, analysed, and governed, how access to land is organised, and who gets a seat at the table to discuss key decisions are questions of urgent concern from both a fair transitions perspective and a land governance perspective. Paralegals and Land Rights in Mozambique
    Reports & Research
    October, 2023
    Mozambique

The race for the exploitation of natural resources has brought challenges of different natures, including land conflicts, mainly between investors and the local population. In some cases, the resolution of problems has been unfair due to the lack of legal knowledge and representation to help the vulnerable population. It is in this context that the paralegal figure was established, endowed with solid knowledge to voluntarily provide basic legal support to community members.

Land access is becoming a crucial issue in many African contexts, where groups and individuals are coping with land scarcity and increasing competition over resources. Thailand

Thailand is undergoing an important development in its forestry laws. When the Community Forest Act B.E. 2562 was passed in 2019, Thailand had for the first time an official umbrella law to recognize community forestry. Subordinate laws still need to be developed to further clarify the Act for its implementation.

A large share of the world's rural population depends on using land to feed themselves. Commercial agriculture and forestry investments are placing growing pressure on land as a resource. Especially when state capacities to steer and monitor land-based investments are low, this can lead to increasing pressure on natural resources, land-use conflicts and in the worst cases to forced expropriation and displacement. These factors can have a negative impact on livelihood and food security in rural areas, particularly when land rights are insecure.

    Formalizing tenure of Indigenous lands
    Journal Articles & Books
    December, 2022
    Brazil

Across the globe, the legal land rights and tenure of many Indigenous peoples are yet to be recognized. A growing body of research demonstrates that tenure of Indigenous lands improves livelihoods and protects forests in addition to inherently recognizing human rights. However, the effect of tenure on environmental outcomes has scarcely been tested in regions with high development pressure, such as those with persisting forest–agriculture conflicts.
