    This State of Land Information (SOLI) report is an analysis of the current state of land data in Botswana, assessing the availability of land information and the compliance of this information with open data standards. 

    The aim of this report is to serve as a diagnostic for the land information ecosystem in Botswana and enable targeted interventions for improved information management.

    In August 2017, Botswana’s parliament passed the Tribal Land Bill, which became the Tribal Land Act no. 1 of 2018. It shall come into operation once the minister sanctions. Until then, the 1994 Act shall be operational. The new Act is aimed at addressing the challenges that cannot be effectively addressed by the operational Act. Some hail it as progressive, but this article argues that the Act has some limitations. Its insistence on the registration of customary grants with the Registrar of Deeds may lead to unintended consequences, such as family conflicts.

    To consolidate and amend the laws in force in the Union relating to the registration of deeds…1. (I) There shall be deeds registries at Cape Town, Kingwilliamstown, Kimberley, Vryburg, Pietermaritzburg, Pretoria and Bloemfontein, each to serve its respective area as defined in the Second Schedule to this Act. The Rand townships registration office at Johannesburg, shall also be a deeds registry, but only in connection with the registration of documents relating to immovable property in any township in the area served thereby as defined in the said Schedule.

    The Act makes provision with respect to titles in land, the development of selected land, and the resolution of disputes regarding land and various other matters relating to land. As a corollary to the principle that land in Lesotho is vested absolutely and irrevocably in the Basotho Nation and is held by the State, no person, other than the State, shall hold any title to land except as provided for under customary law or under this Act. Where the customary law is inconsistent with this Act, this Act shall prevail (sect. 3).

    These Regulations amend the Regulations in terms of the Deeds Registries Act by substituting regulation 16 and by amending provisions concerning, among other things, the description of land, immovable property in partnership deeds, land transferred pursuant to a will, partition in case of inheritance, servitudes and leases.
