    For historical reasons, Kenya inherited a highly skewed system of land ownership at independence in 1963. British colonialism in Kenya was not merely administrative. Rather, it was accompanied by massive and widespread land alienation for the benefit of settler agriculture. As a result the best agricultural land-the White Highlands and the adjacent rangelands were taken from the Africans, without compensation, and parceled out to white settlers. Colonial legislation was enacted to legalize this process.

Population growth, returning refugees, opium poppy production, ethnic tension and drought have increased the pressure on the land. A growing number of rural Afghans are either landless or own plots too small for survival. Competition over pasture is leading to armed clashes between nomads and settled farmers. Neither the Karzai government nor the international community is doing enough to restore order to land relations.

    Research sought to evaluate the determinants of urban land markets, to analyse trends in urban land markets and values, and to assess impacts of urban land prices and policies. Concludes that if current land policies are not reformed there is a risk of increased negative impacts on the poor and more low-income people will be exposed to displacement to areas away from the urban centres which could cause social instability and an increase of informal settlements in suburbs.

    Key findings: Customary tenure remains strong with only 1.2% of plots held under statutory tenure. Over 86% of women reported they have access to land under customary tenure and c.63% of women reported they “own” land under customary tenure. Tenure security is not dependent on formal documentation as proof of ownership. Men play a dominant role in land management. General knowledge of statutory and customary land law and management systems is poor. c.50% of the population have experienced land conflicts, 72% are within household, family or clan.
