    This Act enables the Director of the Department of Land Management to have discretionary authority in the approval of a minor variance in connection with the location of a residential structure within a zone for residential use and to provide an exception for nonconforming buildings and nonconforming use of land. A specialized technical level of review involving land use planning techniques is applied so as to streamline the variance process. This Act also authorizes the Guam Land Use Commission to establish a new fee schedule for the filing of land use applications.

    These Regulations contain rules relative to meetings and proceedings of the Subdivision and Development Review Commmittee created by Executive Order 74-23. Powers of the Committee are somehow defined by the definition of the purposes of these Regulations. The Committee shall review development projects and advise the Territorial Planning Commission on subdivisions. The Committee shall in particular review all subdivisions that require improvements, zone changes and major variances by public agencies concerned.

    This Chapter contains rules relative to the application for a Land Use Permit and the conclusion of land Use Permit Agreements in accordance with Chapter 68 of Title 21 CGA. Chapter 68 prescribes that the Director, with the approval of the Governor, is authorized to grant permits for the use of any suitable government real property, not otherwise occupied or in use, and for any lawful purposes. These Regulations specify criteria of eligibility and procedures for permits and agreements.

    This Act establishes a Provisional Commission for the Zoning of Ancestral Lands, requires the Commission to complete a comprehensive zoning plan for all properties and parcels under the jurisdiction of the Guam Ancestral Lands Commission in accordance with provisions this Act and prescribes procedures for the final approval of the plan. In formulating the comprehensive zoning plan, the Provisional Commission shall request and consider the opinions of all affected ancestral land claimants.

    An Act to clarify the easement rights and obligations of subdivision property owners and the public by adding a new §62112 and amending §62207 of Chapter 62 of Title 21, Guam Code Annotated.

    This Act adds a new section to the subdivision legislation of Guam so as to clarify the rights and obligations relative to public access and utility easements and thereby resolve a possible source of conflict among neighbours. The Act provides for clearer description and accurate registration of rights relative to an easement, access, roadway or right of way.

Articles 2 to 5 provide for use of specific lands and the sale of such land to qualified purchasers. Article concerns a comprehensive development Master plan to be adopted for specified areas.
