    decentralised land management through the creation of local land offices, and (ii)

    certification, which enables individuals to register private property provided the community

    For the estimated 70% of the world population that lives on property without a formal land title, life can be precarious. The absence of ownership documentation raises families’ vulnerability to forced eviction and conflict; it precludes the use of the property to access financial services and other economic benefits; and it diminishes the value of property by restricting its transfer to an informal, opaque market. And yet, in many parts of the world, the process of obtaining a land title is not only expensive but also complicated and sometimes nearly impossible.

    Summary report of baseline findings

    Benin introduced new instruments to register customary land rights in the 2013 Land and Domain Law, which was updated in 2017. The BMZ supported “Promotion d’une Politique Foncière Responsable (ProPFR)” project is testing these instruments together with scalable implementation modalities in the Borgou department (Benin). This work is complemented with a rigorous impact evaluation to assess changes in tenure security, agricultural investments and food security. The baseline survey was completed in 2018 and includes 2,968 households in 53 villages in the Borgou.

    Despite the general consensus on the need for land reforms to boost agricultural development, the lack of blueprint on required actions to safeguard land rights forces many countries to pilot various policy measures with mixed results. Using the TIA (Trabalho de Inquérito Agrícola) 2008 household and parcel level data from Mozambique, this study shows how demand for formalization of individual land rights depends on the source and type of tenure security risks.

    The central themes of this book are customary law, traditional leadership and local land management. International policy is currently witnessing a renewed interest in customary tenure systems and traditional leadership, through which it aims to enhance the efficiency of local governance, and create general access to and secure rights in land. Contrary to these ideas, practice reveals a lack of security of customary tenure in many areas.

    Peri-urban areas in Africa are usually dynamic with respect to land tenure. Statutory, informal and customary tenure systems often co-exist and interfere with each other. This disclosure of legal pluralism often leads to lower levels of tenure security, especially for people with low incomes. Pro-poor land administration tools have been designed to cater for the poor. The question arises whether these tools have the desired impact. This question is answered by confronting the existing tenure regimes with the pro-poor land administration tools.
