The approval by the public of the Constitution at the referendum on August 4, 2010 and its promulgation on August 27, 2010 heralded a new dawn of governance in Kenya. Through its broad provisions, it is expected that it will spur social and economic development and secure the land rights of all Kenyans, by among others guaranteeing them ownership, control and access to natural resources.
This brochure presents the approach and core activities of GIZ Global Program on Responsible Land Policy (GPRLP). The GPRLP is active in Benin, Ethiopia, Laos, Madagascar, Paraguay, Peru and Uganda. In each country, a context specific approach in line with the global GPRLP concept aims at improving the access to land as a core condition for combating poverty and hunger in rural areas for specific population groups, particularly women and socially marginalised groups.
The German Federal Ministry of Economic Cooperation and Development (BMZ) created the Special Initiative “One world, No hunger” aimed to eradicate extreme hunger and poverty. The papers in this volume take a city perspective and provide both a critical reflection of and a pragmatic response to what cities are able to do given their current mandate and powers. The first paper begins by considering what the TOD agenda means for the urban poor. It questions whether TOD can adequately address the existing land challenges in South African cities, given the politics of land inequality and the skewed property markets.
Describes (1) the processes of privatization of land management in selected transition countries and (2) the post-privatization changes in land administration institutions which are being crafted to establish land markets. It begins with the proposition that there are similar land market institutional problems which most "transition" countries are facing, due largely to common experiences in creating command economies during the past 50-80 years and the almost simultaneous decisions of these countries to move toward market political economies in the late 1980s and early 1990s.
The process to develop a new Land Code in Chad is a positive step forward but the draft reflects a highly centralised system of land ownership, management and administration which risks excluding most people from the means to document and protect their land rights while also fostering widespread tenure insecurity. It considers customary rights as ‘temporary’ and gives full legal protection to a land title, which converts customary rights into land ownership, which is likely to be inaccessible for the vast majority of the population.
